KABALE– The High Court in Kabale has began hearing a defamation case in which the Rubanda County West Member of parliament in Rubanda District Moses Kamuntu Mwongyera sued four people including the Rubanda District Deputy speaker and Rubanda District Service commission chairperson.
The hearing of the case kicked off on Tuesday before the Kabale High court Assistant Registrar His worship Gordon Muhimbise but the defendants lawyer Justus Muhangi asked court for leave to file the application of rejection of the petition.
Moses Kamuntu who is the Managing Director of Kamuntu Investments Limited sued Pierre Mbabazi the Rubanda district Deputy Speaker, Dr Narcis Kabatereine the Chairperson of Rubanda District service commission, Henry Wachaga Turinawe and Godfrey Binaisa accusing them of defamation.
Kamuntu through his lawyer Dan Beitwenda of M/S Beitwenda and Company Advocates in civil case number 033 of 2021, says that the defendants publically using different media houses, impersonated themselves to have worked with the plaintiff and Kamuntu investments Uganda limited in the mine at Nyakyonga in Kamuganguzi in Kabale district and Karukara in Rubanda district.
Defendants also claimed that the plaintiff and his company are illegally mining iron ore in Rubanda and Kabale having failed to compensate the alleged land owners which the plaintiff says is a false allegation.
Kamuntu adds that the defendants publically uttered words and made claims that the plaintiff is indebted to them and several others at to a tune of over Ugx 2Bn allegedly arising from compensation and wages. The defendants also claimed that the plaintiff collected money worth Ugx 5M from several people inorder to accept them in his mine and buy their iron ore balls which is untrue and unfounded amounting to defamation.
The legislator adds that the defendants falsely claimed that the plaintiff and his company do not pay taxes and government dues which allegations are baseless are untrue.
The plaintiff, being a Member of Parliament of Rubanda West County wants the defendants to publically retract the said defamatory statements and apology using different media houses which they used to defame his name and also pay general damages of Ugx 500M.
His worship Muhimbise granted the leave and gave the lawyer of the defendants Muhangi up to 12th April 2022 to have filed and served Kamuntu lawyers to also have replied by 26th April 2022. The rejoinder to be filed by 29th April 2022 as the ruling by the Judge will be on notice.
The same court appointed Sharon Kiconco as the mediator between Kamuntu and defendants Pierre Mbabazi the Rubanda district Deputy Speaker, Dr Narcis Kabatereine the Chairperson of Rubanda District service commission, Henry Wachaga Turinawe and Godfrey Binaisa and the report be in court before 29th April 2022.
